Although the Bluebook discusses citation for pending and unpublished cases in Rule 10.8.1, the Bluebook does not provide clear guidance on how to cite to unreported table cases which are also published as slip opinions. There are three options that you can choose from when citing these cases, please follow up with your professor / supervisor / editor about which option you should use.

Cite to the print reporter:

  • Pickard v. Tarnow, 856 N.Y.S.2d 26, 26 (Sup. Ct. 2007).
  • Because it is a table citation, everything is considered to be on page 26, and you cannot provide a pincite to the exact page. Here we are providing a pincite to page 26.

Cite to the print reporter and provide a parallel citation to the unreported case using Lexis, Westlaw or the official slip opinion:

  • Pickard v. Tarnow, 856 N.Y.S.2d 26, 2007 N.Y. Misc. LEXIS 8278, at *2 (Sup. Ct. Dec. 3, 2007).
  • Pickard v. Tarnow, 856 N.Y.S.2d 26, 2007 WL 4374278, at *2 (Sup. Ct. Dec. 3, 2007).
  • Pickard v. Tarnow, 856 N.Y.S.2d 26, 2007 N.Y. Slip Op. 52377(U), at *2 (Sup. Ct. Dec. 3, 2007).
  • Providing a parallel citation allows you to cite to the print reporter and to provide meaningful pincites to the text of the case using the Lexis, Westlaw or official slip opinions. Here we are including a pincite to page *2.

Cite to the unreported case using the Lexis, Westlaw, or official slip opinions:

  • Pickard v. Tarnow, No. 116095/06, 2007 N.Y. Misc. LEXIS 8278, at *2 (Sup. Ct. Dec. 3, 2007).
  • Pickard v. Tarnow, No. 116095/06, 2007 WL 4374278, at *2 (Sup. Ct. Dec. 3, 2007).
  • Pickard v. Tarnow, No. 116095/06, 2007 N.Y. Slip Op. 52377(U), at *2 (Sup. Ct. Dec. 3, 2007).
  • Given that the unreported case is not published in the print reporter, just omit the reporter, use the slip opinion, and provide meaningful pincites. Here, we are including a pincite to page *2.
